By cosigning, Don has made himself contractually obligated to pay the car loan in the event his daughter, Dawn, is unable to do so. Cosigners are jointly and fully liable for the cosigned debt.
Two years later, Dawn loses her job and is unable to pay the car payments, but this time she tells her dad. Of course, dad, in his head is flipping out, but because he loves his daughter, Don is reassuring and calm. In the mean time, she had run up her credit cards in a vain effort to stay afloat and now must file bankruptcy, and she does so. My Attorney Isn’t Helping; What Should A Good Bankruptcy Attorney Do?

I am trying to help my brother who is contemplating bankruptcy. He hired a lawyer who has told him “there’s no hurry” (now 5 months ago) and has not helped him figure out whether settlement is possible. What should a good attorney do? My brother thinks he’s responsible for figuring this out and the attorney just sends in the paperwork. e.g., he’s trying to figure out if college tuition and health insurance are allowable expenses, and how far into the future he could pay it. Shouldn’t a lawyer be able to tell him?
