Renting Cars After Bankruptcy?

A surprisingly common concern from potential clients is the perceived inability to rent a car after bankruptcy. Most car rental companies require a credit card and now run “credit worthiness” reports for people trying to rent a car with a bank debit card. The concern is that the person won’t be able to have a credit card for sometime after bankruptcy, and therefore can’t rent a car.

Bankruptcy is the Closest Consumer Equivalent to Quantitative Easing!

If you have been listening to or reading financial news lately, then you have probably come across the term ‘Quantitative Easing.’ The Federal Reserve announced on November 3 a second round of Quantitative Easing which is referred to as QE2. What is QE? In common sense terms QE entails the Federal Reserve creating money (in this instance, $600 Billion) which it then uses to buy financial assets such as federal and corporate bonds from major banks. Do You Ever Regret Recommending Bankruptcy?

Have you ever regretted recommending bankruptcy to a client?

Answer:

What an interesting and reflective question. The answer is no. Despite all the myths surrounding bankruptcy, bankruptcy is one of a very few areas of law in which a client consistantly emerges from our representation better off than when she started. Is Charge Off Preferable to Bankruptcy?

Question:

Which is better for us, charge off versus bankruptcy.  We have no assets, have over $200,000 in debt, mostly credit card, but wife is starting a job that will pay very good money (probably over $180,000).  We “own” rental properties that are at best worth what we owe, we are selling two of those on land contract.  Our house is rented out, and we are living in a house we are buying on land contract.  We would like to be able to borrow money in the future to finance the house we are living in. Bankruptcy Is About Forgiveness!

The idea of debt forgiveness goes back thousands of years. The Old Testament provides that lenders shall forgive debt every 7 years; Deuteronomy15, 1-11. The interesting thing to note about that passage is that the text places the moral duty on the lender. It was part of a lender’s moral or ethical code to forgive debt every 7 years. Berkus’ Unbreakable Rules For Getting Out of Debt.

1.         Do not rule out any option.

This rule goes to mind set. Many people simply block from their minds the possibility of filing Bankruptcy. Clients will often focus on tactics (the specific option for dealing with the debt) without thinking through the goals and the logical strategy to achieve those goals. By the time I see a client, the goals may dictate a bankruptcy; but the client is letting unrelated issues get in the way. (more…)

Berkus’ Three Rules For Spending Money!

Credit Score Hysteria, A Disease Worse Than Bankruptcy.

Time for the American Psychiatric Association to coin a new disorder: Credit Score Hysteria. Hysteria is behavior exhibiting uncontrollable emotion, such as fear and panic, and loss of rational thought. Credit Score Hysteria is characterized by a person going to extreme lengths, such as destroying their financial well being, in a vain (and always unsuccessful) attempt to preserve his credit score.
